Abstract: Open-source evidence assumes greater importance in international crimes’ prosecution due to its ability to surmount obstacles that international prosecutors and judges confront when investigating violations committed distant from the ICC’s headquarters. about its. In the lack of particular international standards tackling the admissibility and reliability of this type of evidence, the aim of this article is to explore how the ICC rely on open-source evidence, and highlight the challenges arising in this context. Based on case law, the study concludes that the ICC has succeeded in adapting the admissibility criteria of evidence stipulated in the Rome Statute, and adjusting them to open-source evidence. However, legal issues persist and demand consideration by the Court in its future cases when processing this type of evidence.
The relationship between waqf (Islamic endowment) and economic and social development is strong and enduring in the contemporary context. Each influences and is influenced by the other, particularly in light of the Algerian legislator’s commitment to preserving waqf properties, enhancing their productivity, and promoting their development to ensure a greater contribution to sustainable development. This research is limited to the study of the hikr contract, which concerns waqf real estate. The purpose of this contract is to exploit and invest idle or uncultivated waqf lands, as well as waqf-built properties that are threatened by deterioration and destruction and whose revenues are insufficient to finance their restoration. The study adopts a comparative analytical approach by examining the concept of the hikr contract and determining its legal nature under Algerian law and comparative legal systems. The contract establishes a real right known as the right of usufruct, granting the lessee the right to use and exploit the waqf property in order to achieve economic objectives through investment and the reduction of poverty and unemployment. It also serves restorative objectives by ensuring the maintenance and rehabilitation of waqf properties and the reclamation of uncultivated waqf lands. Furthermore, the study analyzes the legal framework governing the hikr contract with a view to identifying the gaps and shortcomings that may hinder the achievement of the objectives underlying its regulation.
This article examines the approach taken by the 2020 constitutional amendment—as well as previous constitutions—to distinguish between the two chambers of parliament, specifically regarding the oversight of government actions and the precision of Article 115 of the current constitution in this regard. The analysis reveals that, despite the merits of the 2020 amendment compared to earlier constitutions and the clarity of its approach to establishing this distinction, the wording of Article 115—the provision underpinning this differentiation—did not differ significantly from previous versions, nor did it avoid the shortcomings that had plagued earlier constitutions. . Keywords: Constitutional methodology - Bicameral system - Parliamentary oversight - Government actions This article aims to examine the methodology of the current (2020) Constitution and previous constitutions in establishing bicameralism, and the accuracy of Article 115 of the current Constitution in embodying bicameral oversight of government actions. It has become clear that while the current Constitution has its advantages compared to previous constitutions, and despite the clarity of its methodology in achieving bicameralism, Article 115, which is the foundation of this bicameralism, does not differ significantly in its wording from previous versions and does not avoid the shortcomings that plagued earlier constitutions.
Digital Sovereignty and International Conflict: The Role of Cyberspace in Contemporary Global Politics
The absence of a binding international legal framework increases the risk that cyberspace will remain unregulated, dominated by the interests of major powers. Cyberspace has become a key domain in international relations, reflecting the rapid development of information technologies and global interconnectedness, while creating new opportunities for conflict and cyberattacks targeting critical infrastructure, government, financial, and electoral institutions. This study examines the application of international law principles in cyberspace, such as sovereignty, prohibition of the use of force, and non-interference, and evaluates the effectiveness of existing legal frameworks in holding states accountable. It also analyzes international instruments and notable incidents, including the attacks on Estonia, Operation Stuxnet, and the SolarWinds breach, to highlight legal and procedural challenges in regulating cyberspace.
AN ANALYTICAL READING OF THE POWERS OF THE NATIONAL AUTHORITY AND THE HIGH AUTHORITY FOR TRANSPARENCY, PREVENTION, AND COMBATING CORRUPTION IN LIGHT OF LAWS NO. 06-01 AND 22-08
Due to the rise and spread of corruption cases, Algeria adopted a legal framework to prevent corruption and limit its harmful effects on institutions and society. Law No. 06-01 was a step because it established the framework for combating corruption and created the National Authority for the Prevention and Fight against Corruption. However, its role remained mostly consultative, limited to proposing policies, issuing recommendations, and supervising measures without enforcement powers. Under the 2020 Constitution, the High Authority for Transparency, Prevention and Fight against Corruption was created and regulated by Law No. 22-08, with powers in investigation, coordination, transparency, and oversight. Therefore, replacing the former authority reflects a qualitative shift toward a more effective and rigorous anti-corruption policy.
Air sovereignty of states in the face of drones, ‘Case study: Downing of the Maliane drone by Algerian forces)
Abstract: Unauthorized airspace intrusions by military and civilian drones present critical challenges to state sovereignty and international law. This study examines the legal framework governing the protection of aerial sovereignty against illicit drone usage, focusing on the Algerian army's downing of a Malian drone. Utilizing an analytical approach, the research assesses the legality of this interception under international law. It concludes that the Algerian action constitutes a legitimate exercise of self-defense under Article 51 of the UN Charter due to the unauthorized entry, highlighting the vital balance between preserving state sovereignty and adhering to international legal limits on the use of force.
Neurolaw and Neurocriminology: A Prospective Study on the Use of Neuroscience in Algerian Courts
This study examines the emergence of neurolaw and neurocriminologie and their potential use in Algerian courts. It addresses the issue of how Algerian judges may receive neuroscientific evidence derived from brain imaging techniques. The study hypothesizes that such evidence is not yet integrated into Algerian judicial practice. Using a descriptive and analytical methodology based on scientific studies and foreign case law, the research aims to highlight the importance of neuroscience in judicial proceeding and the need for specific legislation in Algeria. The study concludes that Algerian law remains unprepared for neuroscientific evidence despite the significant legal, ethical, and technical challenges it raises.
