Abstract : The presumption of innocence is a fundamental principle upon which both Islamic jurisprudence and positive law are based, as it establishes the protection of individuals from arbitrariness and ensures the safeguarding of their freedom and dignity. The underlying principle is that a person is innocent of accusations, which constitutes the cornerstone of achieving justice and preventing injustice. Islamic Sharia recognized this principle from an early stage through its comprehensive rules and general objectives that emphasize the rejection of doubts and the protection of rights. Modern positive legislation has also adopted it and made it one of the essential guarantees for a fair trial. From this perspective, this study aims to highlight the presumption of innocence from two integrated angles: the angle of theoretical foundation by explaining its legal and Sharia origins, and the angle of practical impact by analyzing its implications on criminal procedures and the guarantees afforded to the accused. This is intended to demonstrate the effectiveness of this principle in achieving criminal justice, and the extent of the balance between protecting society and safeguarding individual rights.
