The independent regulatory authorities in the banking sector represent newly established bodies mandated by the legislator to oversee the banking sector. They are granted the power to exercise functions originally within the jurisdiction of the executive and judicial authorities. The Monetary and Banking Council issues regulations and individual decisions in the areas of currency and lending, while the Banking Committee imposes sanctions on any party whether a bank, financial institution, other regulated entities that violates legislative and regulatory provisions. exercise of their regulatory functions by these two bodies may infringe upon the rights of economic operators in this sector. This consequently necessitates their submission to adjudicate such matters originally lies with the administrative judiciary represented by the Administrative Court of Appeal of Algiers pursuant to the organic criterion. This was previously under the jurisdiction the Council of State. Although we are dealing with a single sector, its litigation is characterized by particular specificity due to the lack of unified procedures; oscillates between the application of monetary and banking law rules and the referral to general legal rules.
