The technological advancement in the field of commerce has led to significant changes in the rules governing e-commerce law, particularly affecting the trade of pharmaceutical products in general and medicines in particular via the Internet. This mode of trade entails risks to public health, especially for the consumer of medicinal products, due to the lack of certainty that such products are obtained from a pharmacist legally authorized to dispense them. Moreover, the consumer’s virtual presence behind a screen and reliance on electronic correspondence to inquire about the acquisition of medicines cannot, in any way, substitute for the physical presence of both the patient and the pharmacist within the same geographical setting—namely, the pharmacy—in order to receive detailed advice, instructions, indications, contraindications, and related information. Furthermore, pharmaceutical products themselves are classified into high-risk substances and others of lower risk, which necessitates that legislation regulate them through differentiated rules according to their degree of risk, as exemplified by the French legislator. This research paper aims to examine the extent to which the legal rules established by the French legislator are adequate to protect consumers of medicinal products from the adverse effects of e-commerce.
