This study examines the relationship between electoral legitimacy and constitutional constraints within the framework of the modern democratic state. Democracy today is no longer understood merely as an electoral mechanism, but rather as a comprehensive constitutional system based on a delicate balance between the will of the people and the protection of rights and freedoms. The study starts from the premise that elections, despite their importance in granting political legitimacy, may not be sufficient to guarantee a genuine democratic practice if they are not accompanied by effective constitutional and institutional safeguards. It also highlights that the principle of popular sovereignty, which constitutes the foundation of democracy, can be interpreted in ways that may allow the concentration of power when mechanisms of accountability and checks and balances are weakened. Therefore, the study analyzes the role of the constitution, the separation of powers, and judicial independence in protecting the democratic system from potential deviations. The paper concludes that genuine democracy requires a balance between electoral legitimacy and the rule of law, ensuring that popular will does not undermine constitutional guarantees. Consequently, strengthening constitutional culture and respecting institutional limits remain essential for maintaining a stable and balanced democratic order.
