Abstract: Custody is not an absolute right granted to the custodian without limitations; rather, it is subject to a set of controls and conditions, the breach of which results in the loss of custody. The primary purpose of custody lies in caring for the child and raising them in accordance with their father’s religion, while ensuring their physical and moral well-being. Accordingly, custody should only be revoked when this purpose is undermined or when the legally prescribed conditions are violated. However, the legislator has provided for other grounds for the loss of custody even where this intended purpose is fulfilled, without due consideration for the best interests of the child, which constitute the paramount foundation of their protection. Among the most notable of these grounds is the custodian mother’s marriage to a man who is not to a person outside the prohibited degrees, which leads to an automatic loss of custody, despite the potential harm this may cause to the child’s best interests. This study aims to examine the role of the judiciary in striking a balance between statutory provisions, which enumerate the grounds for loss of custody in a restrictive manner, and the imperative of upholding the best interests of the child, which may necessitate departing from a strict or literal application of such provisions. This is achieved through the adoption of a flexible, purposive judicial interpretation and through judicial scrutiny of the extent to which the statutory grounds for loss are consistent with the fundamental objective of custody, namely the protection and care of the child.
Abstract: Civil liability for environmental damage has occupied a prominent place in the field of legal studies and research dealing with the environment and its protection from pollution, particularly compensation for environmental damage. The damage must be direct and real, and affect a legitimate right or interest of the injured party, whether one person or several natural or legal persons. Civil liability arising from environmental pollution does not fit within the traditional framework of civil liability, which is incapable of accommodating all environmental pollution disputes and providing protection to those affected in light of the increasing difficulties. The study aims to examine the foundations upon which civil liability for environmental damage is based, the conditions for accepting a claim for compensation for environmental damage, and the powers granted to judges to assess compensation. It also aims to determine the effectiveness of legal protection for the environment, and whether the general rules of civil liability are sufficient to address environmental damage in terms of compensation, or whether a special compensation system is required that is consistent with the specifics of environmental damage.
