تناول البحث دراسة موضوع حماية الممتلكات الثقافية خلال النزاعات المسلحة في الشريعة الإسلامية والقانون الدولي الإنساني، حيث تم تسليط الضوء على موقف الشريعة الإسلامية السمحة من حماية هذا النوع من الأعيان، باعتبارها كانت السباقة في إرساء نظام قانوني متكامل تضمن أحكام ومبادئ تنظم سير العمليات العدائية، كما استعرض بالتفصيل تطور مختلف أنواع الحماية القانونية المقررة لهذه الأعيان بموجد قواعد القانون الدولي الإنساني، ليتطرق إلى مبدأ المسؤولية الجنائية الدولية المترتبة عن استهداف هذه الممتلكات خلال النزاعات المسلحة ، من خلال الحكم التاريخي الذي أصدرته المحكمة الجنائية الدولية عند فصلها في قضية "الفقي المهدي" (حالة مالي). The research dealt with the subject of protecting cultural property during armed conflicts in Islamic law and international humanitarian law, where the position of the tolerant Islamic law was highlighted on the protection of this type of property, as it was the first to establish an integrated legal system that included provisions and principles regulating the course of hostilities. It also reviewed in detail the development of the various types of legal protection stipulated for these properties under the rules of international humanitarian law, to address the principle of international criminal responsibility resulting from targeting these properties during armed conflicts, through the historic ruling issued by the ICC when it decided on the case of " Al-Mahdi" (Situation in Mali).
